According to the definition by the General Administration of Quality Supervision, Inspection, and Quarantine of the People’s Republic of China, counterfeit products refer to those that falsely use factory names, addresses, trademarks, product names, and product identification to mislead customers into believing that they are genuine products. The General Administration of Quality Supervision, Inspection, and Quarantine specifies several main situations of counterfeit and substandard products:

- Counterfeiting or using other people’s factory names and addresses.

- Products without inspection certificates or permits from relevant units.
- Domestic products without Chinese product names, producers, and places of origin (important industrial products without factory addresses).
- Products with limited use but without marked expiration dates.
- Products subject to production (manufacturing) license management but without marked license numbers and validity periods.
- Failure to indicate specifications, grades, main technical indicators, components, and contents in Chinese as required by relevant regulations.
- High-end durable consumer goods without Chinese instructions.
- Products that belong to processed goods (including substandard or exterior products) but are not marked with the words “processed goods” on the prominent parts of the goods or packaging.
- Dangerous goods such as highly toxic, flammable, or explosive goods without relevant signs and instructions.
How to deal with suspected counterfeit products? The industry and commerce department will order correction, confiscate products, and impose fines based on normal legal procedures for the dual systems. According to the provisions of China’s Criminal Law, serious production of counterfeit and substandard products constitutes a crime. Serious circumstances refer to sales amounts reaching 50,000 yuan or goods valued at 150,000 yuan.
Article 50 of the Product Quality Law stipulates that mixing, adulterating, passing off inferior products as good ones, or passing off unqualified products as qualified ones shall be ordered to stop production and sales, confiscate illegally produced and sold products, and impose fines of fifty percent to three times the value of the goods sold. If illegal gains are obtained, they shall be confiscated. For serious cases, business licenses shall be revoked, and if it constitutes a crime, criminal responsibility shall be pursued according to law.
